RE: The tariff classification of scrap material from the Bahamas.

Dear Ms. Lui:

In your letter dated July 11, 2008 you requested a tariff classification ruling. The merchandise to be imported is scrap material consisting of junked Japanese, German and American made vehicles. Collected and crushed down in the Bahamas, each of these vehicles is typically comprised of 55% steel sheet metal and 30% cast iron, along with smaller percentages of other metals. These crushed down junked vehicles are imported into the United States strictly for recycling purposes.

The applicable subheading for the scrap material will be 7204.49.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for ferrous waste and scrap, remelting scrap ingots of iron or steel, other waste and scrap, other, other. The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
